Civil Traffic Infractions

Most civil traffic infraction hearings are heard before a Hearing Officer. Those who receive a traffic citation have the option within (30) days of paying the traffic fine as written on the citation, attending a driver improvement course or requesting a hearing to contest the citation.

Judge Schiff Discusses Traffic Court

During any hearing the court will take testimony from law enforcement, witnesses for the state or any witnesses you may bring who witnessed the event. The driver must provide his or her own language interpreter if needed. After hearing all the evidence the court will determine whether guilt has been proven beyond a reasonable doubt. If the matter is not proven beyond a reasonable doubt, the citation will be dismissed. If the matter is proven beyond a reasonable doubt the court may impose a fine, court costs or other relief as permitted by law.
