AGREEMENT FOR USE OF THE TRIAL COURT ADMINISTRATOR'S WEB BASED MOTION CALENDAR SCHEDULING This website is provided by the Trial Court Administrator of the Seventeenth Judicial Circuit (herein "Trial Court Administrator") as a service to attorneys and pro se litigants to schedule motion calendar hearings with participating judges. This website is intended solely for the scheduling of motion calendar hearings and is not an official court record. Access to official court records is available only from the Clerk of Courts. The account named on the Trial Court Administrator's records under which you registered is the User. The term User as used in this Agreement also includes both the User and each person delegated authority by the User. Each delegated user under the account is required to accept this Agreement and agrees to abide by all of its terms individually and as an agent of the User. Both the User and delegated user are bound by the terms of this Agreement. The User and delegated user are each responsible for any liability arising out of the misuse of this website or any other violation of this Agreement. The User is expressly prohibited from reproducing, publishing on-line, selling, reselling or otherwise disseminating data or information accessed pursuant to this Agreement, except as permitted by law. The information accessed is not intended or permitted to be used for commercial resale, except as permitted by law. The date available for participating judges' motion calendar is provided by the participating judges and not by the Trial Court Administrator. Any changes to available dates for motion calendar are provided by the participating judges and not the Trial Court Administrator. Any and all questions with regard to the dates for motion calendar must be directed to the participating judge and not the Trial Court Administrator. Dissemination of any information accessed pursuant to this Agreement is subject to and controlled by United States Code, Florida Statutes, court rules of procedure, administrative orders, and court orders. The information presented on this site is generally updated in near real time but events may occur which delay the data updates and/or the website's availability. Therefore, the information available through this site is not warranted to be accurate or current. Only the official court records available from the Clerk of the Courts should be relied upon as accurate and current. This website is intended to be available seven (7) days a week, twenty four (24) hours a day but the Trial Court Administrator makes no guarantee in this regard due to scheduled maintenance, downed server connections, or other matter which impacts the ability to "log in" and schedule a motion calendar hearing. The User is responsible for the appropriate use, maintenance and control of the 'User Identification' (User ID's) and 'Password(s)' associated with the use of this site as well as any delegated users. Any loss of password control should be immediately corrected by the User or delegated user by either changing the password or, if necessary, requesting a change of the User account name (User ID). Unauthorized access, utilization, disclosure or modification of exempted matters that fail to exist or have been breached or any alteration of any component of this site is expressly prohibited and is punishable as provided by law. Unauthorized attempts to upload or change information on this website are strictly prohibited and may be punishable under any and all applicable laws. Without waiving any other defenses or immunities provided by law, the Trial Court Administrator shall not be liable for any demand or claim, regardless of form of action, the scheduling of a motion calendar hearing on this website, arising out of or incident to the posting of information or data on this website, the accessing or use of any information or data on this website, and/or the acts or omissions of any person or entity accessing or use of any information from this website. This includes, but is not limited to, claims arising out of or incident to incorrect or incomplete data or information accessed pursuant to this Agreement. All users are advised to independently verify any information or data obtained pursuant to this Agreement with the official court record information in the custody, control, or possession of the Clerk of Courts. User agrees that the services are provided "as is"; neither the Trial Court Administrator or her employees nor the participating judges and his or her judicial assistants make any representation nor warranty with respect to accuracy, completeness, or currentness; and they specifically disclaim any other warranty, express, implied or statutory, including any warranty of merchantability or fitness for a particular purpose. Neither the Trial Court Administrator, her employees and agents, nor the judges and his or her judicial assistant expressly or impliedly warrant that the information or data accessed by user is accurate or correct. There are no expressed or implied warranties in connection with this service. They shall not be liable on account of any such errors, omissions, delays, or losses. User agrees that in no event will the Trial Court Administrator her employees and agents, nor the judges and his or her judicial assistant are liable for the results of user's use of the services, inability or failure to conduct his/her/its business, or for indirect, special or consequential damages. The foregoing limitation of liability and exclusion of certain damages shall apply regardless of the success or effectiveness of other remedies. User hereby relieves and releases the Trial Court Administrator her employees and agents, and the judges and his or her judicial assistant from liability from any and all damages resulting from interrupted service of any kind. Nothing in this Agreement shall be construed as waiving the sovereign immunity of the Trial Court Administrator her employees and agents, or the judges and his or her judicial assistant. The Trial Court Administrator provides no warranties of any kind or nature, express or implied, and specifically disclaims any and all warranties of any kind or nature, express or implied, and specifically disclaims any and all warranties with regard to any computer programs, materials or services in connection with this website. The Trial Court Administrator diligently strives to maintain accurate, complete and timely data on this website but shall not be liable for any consequential, exemplary, incidental or special damages arising from or in connection with data or information accessed via this site. Please note that this website with respect to data collected and used by the Trial Court Administrator in connection with this website are governed by this Agreement as amended from time to time, and not the Agreement in effect at the time the data was collected. Please regularly review this Agreement. If you have objections to the Agreement, you should immediately discontinue use of this website and follow the procedure to update your personal information and privacy preferences. This Agreement does not govern privacy practices associated with offline activities, websites other than this website, or products and services not available or enabled via this website. Notwithstanding the foregoing, to the extent that any terms of this Agreement conflict with the terms of an existing written (including electronic) agreement between you and the Trial Court Administrator regarding the use of specific areas of this website, the terms this Agreements shall govern. The website is intended for attorneys and pro se litigants over the age of 18 and the Trial Court Administrator does not knowingly collect any personal information from anyone under 13 years of age. All personal information ("personal information" is defined as any information that identifies or can be used to identify the person to whom such information pertains) that the Trial Court Administrator collects and maintains will be subject to this Agreement, as amended from time to time. The Trial Court Administrator may change this Agreement from time to time at her sole discretion and will provide notice of changes in the Agreement on the "log in" page for this website. If as the result of such changes you want to alter the ways in which the Trial Court Administrator is allowed to use your personal information, you can do so by following the procedures to update your personal information and privacy preferences. You will be deemed to have been made aware of, and will be subject to, the changes to this Agreement after such notice has been posted with the following exception: if at the time you provide personal information to the Trial Court Administrator you limit how such information will be used to communicate with you, either by the Trial Court Administrator or by third parties, the Trial Court Administrator will not change your preference in this regard without your express consent. However, if the function of the Trial Court Administrator is acquired by or merged with another entity, you agree that the Trial Court Administrator may provide to such entity personal information that is related to that part of her duties and responsibilities that was acquired or merged with the other entity without obtaining your further consent, but the Trial Court Administrator will provide notice of acquisition or mergers on this website. User personal information on this website is collected by the Trial Court Administrator who is responsible for this site. For example, the Trial Court Administrator may log environmental variables, such as browser type, operating system, CPU speed, referring or exit web pages, and the Internet Protocol (IP) address of your computer. The Trial Court Administrator may also use such information to measure traffic patterns on the website and usage of the website. The Trial Court Administrator does not match such information with any other information held by her unless she has your consent. By using this website, you agree and acknowledge that personal information collected through the website may be transferred across national boundaries and stored and processed in any of the countries around the world in which the Trial Court Administrator determines it is appropriate to store data, including the United States. For example, if permitted under applicable law, we may supplement your personal information with address information provided by The Florida Bar or the U.S. Postal Service to qualify your information and prevent errors in our database. The Trial Court Administrator collects your information in order to record, support and facilitate your participation in the scheduling of motion calendar hearings. If you register for the scheduling of motion calendar hearings the information is used to register your rights, if any, to technical support or other benefits that may be made available to registered users. The Trial Court Administrator may collect information about the use of the website such as the number of downloads, types of services used, the number of daily users, and the IP/Internet address of your computer. This information is collected in aggregate form, without identifying any user individually. The Trial Court Administrator may use this aggregate, non-identifying statistical data for improving the website, providing more relevant experiences to the registered users, and for statistical analysis. Use of this website may require you to use the most current version which you may or may not have already downloaded. The Trial Court Administrator may automatically check to determine if you are using the most current version and through e-mail messages, pop-up boxes or similar mechanisms to inform you if need to upgrade in order to use this website. During this process, an IP address identifying your computer and the version may be sent to a Web server, but system profile information is not transmitted nor are cookies used to store information. The Trial Court Administrator recommends that you do not divulge your password to anyone. Please note that any information you post to a public bulletin board or public website or chat room is available to all persons accessing that location, and your e-mail address may also be posted on these venues. The information you share, including your e-mail address, would then be available to all persons accessing these venues, and such information may be read, collected or used by others for any purpose, including sending you unsolicited messages. The Trial Court Administrator is not responsible for any information you elect to submit to any other entity or website or other public venue. Personal information that is not collected on this website is not generally subject to this Agreement. In order to improve the website and provide more convenient, relevant experiences to users, the Trial Court Administrator may use "cookies", "web beacons", and similar devices to track your activities. A cookie is small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card and enables the Trial Court Administrator to record your passwords and preferences. It cannot be executed as code or deliver viruses. A web beacon is a small transparent gif image that is embedded in an HTML page or e-mail used to track when the page or e-mail has been viewed. The web beacon is similar to a cookie in that it tracks your visit and the data can only be read by the server that receives the data. It is different than a cookie in that it is not browser-based, may not function as an identification card, and does not store any data on your computer. While the Trial Court Administrator uses cookies and similar devices to track your use of the website, such as the number of downloads, types of services used and downloaded, and how many users the website receives daily; the Trial Court Administrator's web servers may automatically log the IP/Internet address of your computer, but the Trial Court Administrator does not generally use this information to identify you personally. Legal title to the website shall remain with the Trial Court Administrator as her sole property. Use of this website constitutes acceptance by the User of the terms of this license. The Trial Court Administrator grants User a non-transferable, non-exclusive, limited license to use this website subject to the conditions of this Agreement. This License shall apply to any form of access. The Trial Court Administrator reserves the right to limit access or terminate User's License at any time. There shall be no waiver or modification of this Agreement unless in writing and signed by the Trial Court Administrator and User. This Agreement shall be construed under the laws of Florida. User accepts this website as is, without any warranty of any kind. This Agreement shall remain in force as to confidentiality and limitations of use as long as the User is using this website.
