THE PROBATE DIVISION SUPPORT STAFF

PROGRAM ATTORNEY:
Corresponds with attorneys, heirs/beneficiaries and the general public seeking information or guidance regarding estate and trust matters.  The Program Attorney also assists and advises employees in the Probate Clerk's Office as to law and procedure..
Corresponds with attorneys, guardians, family members and general  public seeking information or guidance regarding incapacity, mental health and guardianship issues.
The Program Attorney also assists and advises employees in the Probate Clerk's Office, Office of the Public Guardian and Guardianship Investigator/Court Monitor as to law and procedure.  This position reviews reports of Guardianship Investigators and assists the Judiciary  in determination of whether a case should be presented to State Attorney's Office for prosecution and if so, assists with preparation and presentation of the case.

GUARDIANSHIP INVESTIGATOR/COURT MONITOR:
Conducts field investigations and joint investigations with law  enforcement, as assigned by the Court, when allegations of fraud, abuse or exploitation of a minor or elderly ward are received or suspected. The Investigator/Monitor also reviews all guardianship applications for investigation, conducts criminal and credit background checks and Department of Children and Families reports, and provides the Presiding Judge with written recommendations.

STAFF ATTORNEYS
Review all guardian and attorney fee petitions prior to review by the  Presiding Judge. The Staff Attorneys also conduct research and draft opinions regarding all estate, trust, and guardianship matters.
